Manchester Ship Canal discharges case heads to the Supreme Court
The Supreme Court is expected today to hear an attempt to overturn a decision of the High Court on whether United Utilities can be held liable by Peel Ports for discharges into the Manchester Ship Canal.
According to a Financial Times report, United Utilities will argue that only regulators can take action. The High Court previously ruled in support of that argument.
The new case, which the FT described as a test case which could have implications for other private interests seeking to sue water companies discharging untreated sewage, is supported by the Good Law Project and the Environmental Law Foundation.
