Competition watchdog opens Enterprise Act inquiry into Pennon Group's acquisition of Bristol Water

by Karma Loveday

The Competition and Markets Authority (CMA) has formally launched its inquiry into the completed acquisition of Bristol Water by Pennon Group.

Today it began "Phase 1" work under the Enterprise Act 2002. It invited comment by any interested party by 1 October, and will announce its decision as to whether to refer the merger for a "Phase 2" investigation by 12 November.

The CMA is examining whether the merger has resulted in a substantial lessening of competition under the Enterprise Act. It also plans to scrutinise whether the merger is likely to prejudice Ofwat’s ability to make comparisons between water enterprises under the Water Industry Act 1991.
